1. Agreement to these terms
By accessing, registering for, or using Black Cow AI ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service.

2. What the Service provides
Black Cow AI is an artificial-intelligence platform that helps small and medium businesses create, analyse, and improve advertising campaigns, competitor reports, creative concepts, and marketing plans. Outputs are generated by AI and are intended as a starting point for your own review, editing, and approval.
We do not guarantee that any AI output will be suitable, lawful, or effective for your specific situation. You remain responsible for deciding whether to publish, fund, or act on any output.
3. Eligibility and accounts
To use the Service, you must be at least 18 years old and capable of entering into a binding contract. If you are using the Service on behalf of a business, you confirm that you have authority to bind that business to these terms.
You must keep your account credentials secure and promptly notify us of any unauthorised use. You are responsible for all activity that occurs under your account.
4. Your content and intellectual property
You retain ownership of any business information, logos, images, copy, and other materials you upload to the Service ("Your Content"). You grant us a limited licence to use, copy, and process Your Content solely to provide, improve, and secure the Service.
We do not claim ownership of AI-generated outputs created for you. However, because AI-generated content may not be eligible for copyright protection in every jurisdiction and may resemble content generated for others, we cannot guarantee that any output is unique or free from third-party rights.
5. Acceptable use
You agree not to use the Service to:
- Violate any applicable law, regulation, or advertising platform policy (including Meta, Google, and other ad networks).
- Create, publish, or promote misleading, fraudulent, defamatory, discriminatory, hateful, or illegal content.
- Infringe the intellectual property, privacy, or other rights of any third party.
- Reverse-engineer, scrape, or interfere with the Service's infrastructure or security.
- Send spam, unsolicited messages, or bulk communications without proper consent.
- Use the Service in a way that could harm, disable, or overburden our systems.
We may suspend or terminate your account if we reasonably believe you have breached these rules.
6. Advertising and third-party platforms
The Service may generate copy, creative concepts, and targeting suggestions for advertising platforms such as Meta, Google, Instagram, LinkedIn, and others. You are solely responsible for:
- Your own advertising accounts, billing, and compliance with each platform's terms and policies.
- Reviewing and editing any AI-generated ad copy or creative before publishing it.
- Ensuring your ads comply with consumer protection, data protection, and industry-specific rules.
- Any claims, warranties, or representations made in your advertising.
Connecting your Meta or other advertising accounts via our custom OAuth integration is optional. You may revoke access at any time through your platform settings or by contacting us.
7. Pricing, plans, and credits
During the waitlist and early-access period, the Service may be offered free of charge or with usage limits. We will notify you before introducing paid plans, subscriptions, or credit-based pricing.
Any paid subscription terms will be shown clearly before you confirm a purchase. Unless otherwise stated, fees are non-refundable except where required by law.
8. Confidentiality and data handling
We treat the business information and generated outputs you store in the Service as confidential. We use the technical and organisational measures described in our Privacy Policy to protect your data. You remain responsible for classifying and handling any sensitive information you choose to upload.
9. Termination and suspension
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these terms, if required by law, or if we discontinue the Service.
On termination, your access to the Service will end. Your Content may be deleted in accordance with our retention practices described in the Privacy Policy.
10. Disclaimers and limitation of liability
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not guarantee that the Service will be uninterrupted, error-free, secure, or that AI outputs will produce business results. You use the Service and any AI-generated output at your own risk.
To the maximum extent permitted by law, our total liability to you for any claim arising from or relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the event giving rise to liability, or (b) £100.
Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.
11. Indemnification
You agree to indemnify and hold harmless Black Cow AI, its directors, employees, and agents from any claims, losses, damages, or expenses (including reasonable legal fees) arising out of or relating to:
- Your use of the Service or any AI-generated output.
- Your Content or any advertising you publish using the Service.
- Your breach of these terms or any applicable law or third-party right.
12. Governing law and disputes
